The civil trial process typically follows several well-worn steps. First, the plaintiff files a complaint – popularly known as a lawsuit – with the appropriate court. The complaint outlines the nature of the case, the legal theory under which it has been brought and the relief or damages sought.
Next, the court sends a summons – a request to appear in court – to the defendant. Once this occurs, the defendant has a certain amount of time to respond to the complaint with an admission or denial of the complaint’s allegations. At this point, the parties to the case may choose to negotiate a settlement and avoid an actual trial. If this does not occur, the case begins to move toward the trial phase.
As the trial date approaches, the plaintiffs and defendants – or their representatives – engage in pre-trial motions, evidence discovery, conferences and other preparatory activities. During the trial itself, each party presents its case to the presiding judge and/or the jury he or she supervises. The parties may introduce physical evidence, call witnesses and make oral arguments in support of their respective versions of events.
Once both sides have made their arguments, the judge typically issues a ruling or ratifies the jury’s verdict. In many circumstances, the case’s resolution can be appealed to a higher court.
